Good Afternoon and Happy New Year-

Those of us who believe in home ownership and real estate as a sound investment should be relieved to see the passage of the "Fiscal Cliff Bill." While "the bill" addresses a labyrinth of government regulated issues you may be most interested to know specifically the impact on your real estate assets.

Summary of real estate related provisions in the bill:

Real Estate Tax Extenders

* Mortgage Cancellation Relief
is extended for one year to January 1, 2014.

* Deduction for Mortgage Insurance Premiums for filers making below $110,000 is extended through 2013 and made retroactive to cover 2012.

* Leasehold Improvements: 15 year straight-line cost recovery for qualified leasehold improvements on commercial properties is extended through 2013 and made retroactive to cover 2012.

* Energy Efficiency Tax Credit: The 10% tax credit (up to $500) for homeowners for energy improvements to existing homes is extended through 2013 and made retroactive to cover 2012.

Capital Gains
Capital Gains rate stays at 15% for those at the top rate of $400,000 individual and $450,000 joint return. After that, any gains above those amounts will be taxed at 20%. The $250/$500k exclusion for the sale of a principal residence remains in place.

Estate Tax
The first $5 million dollars in individual estates and $10 million for family estates are now exempted from the estate tax. After that, the rate will be 40%, up from 35%. The exemption amounts are indexed for inflation.


I believe these are steps in the right direction for the ongoing recovery of the real estate market. 2012 statistics show an increase in average sale price and units sold. Due to the fact that real estate markets are local, there are differences in how these increases have impacted various metro statistical areas.
Real estate continues to provide a hedge against inflation, tax shelter, and appreciation over time. In many cases it also produces cash flow.
We still have an active market for REO and foreclosure properties. There are still great opportunities in both the commercial and residential sectors that are difficult to resist for anyone with an itch to delve into investment, purchase their first home or trade up.

I expect 2013 to be another busy year as the real estate recovery stays on track.

The mortgage interest deduction is being threatened by some congressional leaders. Loss of the mortgage interest deduction would have the greatest impact on middle income property owners. REALTORS oppose the elimination of the mortgage interest deduction.

Realtors also oppose legislation known as QRM, Qualified Residential Mortgages, to require minimum down payments of at least 20% for a home purchase. This is considered a road block to recovery in the housing market. A National Association of Realtors study indicates that it would take 14 years for most purchasers to accumulate enough savings for a 20% down payment.

Weak underwriting guidelines are the main cause of mortgage defaults, not properly under written mortgages with affordable down payments. Responsible, qualified borrowers desiring home ownership should not be penalized by the overzealous and unscrupulous lending practices utilized by predatory lenders in the recent past.

Realtors are the only political advocates for home owners and we take that task very seriously.

Home ownership contributes to the stability of neighborhoods, strengthens communities and is good for the country as a whole. Real estate ownership is still the best hedge against inflation.

Home owners pay 80-90% of federal income taxes. Each home purchase may inject more the $60,000 into the economy for furniture, home improvements and related items.

Home ownership is a hedge against inflation and provides control over the cost of shelter.

There is a reason home ownership is called the American Dream. People aspire to home ownership for the financial and social benefits it conveys. Housing supports America. America should support housing.

I am pleased to report that all Park Place Real Estate agents are keeping busy with buyers and sellers this summer!  There is still an open window of opportunity for buyers and sellers alike!  Prices are still low but recent statistics show slight but consistent increases.  Interest rates are in the range of 4% for 30 year primary residence mortgages.

Realtors met last week in Washington DC for the NAR Mid-Year Political Legislative Meetings. 

These meetings address pressing issues related to today’s housing market, particularly those related to access to and opportunities for property ownership,” said Nancy Fish, President of GKAR and owner of Park Place Real Estate in Kalamazoo. “Last week, REALTORS® made lawmakers aware of how important it is to ensure that anyone who is able and willing to assume the responsibilities of owning a home can do so, now and into the future. The meeting with a few other GKAR members and Congressman Fred Upton focused on issues surrounding the real estate market in the Kalamazoo area, including ensuring access to affordable mortgage products for potential property owners, reforming the secondary mortgage market so that a continual flow of mortgage liquidity is available in all markets, and preserving tax benefits for real estate ownership, including the mortgage interest deduction (MID). We also urged Congressman Upton to support requirements and practices to streamline short sales.”
